Why Physical Evidence Matters After a Marine Accident
An investigator may document the vessel's condition and identify a defect, but determining whether that defect contributed to an accident requires additional analysis. Evidence may need to be compared with maintenance records, operating conditions, witness statements, and other information.
This prevents a common investigative problem: confusing the existence of a defect with proof that the defect caused the event.
Testing Can Go Beyond a Visual Inspection
Some evidence cannot be fully evaluated through photographs or visual examination alone.
Depending on the vessel and investigation, specialized testing may be appropriate. Non-destructive testing methods can provide additional information while minimizing alteration to the component being examined.
Ultrasonic thickness testing, for example, can be used to assess material thickness in relevant structures. Other inspection methods may help evaluate machinery, electrical systems, or areas where damage is not readily visible.
The appropriate testing method depends on the technical question being asked. A sophisticated test is not automatically useful simply because it is available. Its value comes from whether it can provide information relevant to the investigation.
Preserving Damaged Components
Sometimes the most important evidence is a physical component that has been removed from the vessel.
A failed fitting, damaged mechanical part, section of structure, or electrical component may need to be retained for further examination. Where practical, its condition and location should be documented before removal.
Handling can also matter. An object that is cleaned, repaired, modified, or discarded before examination may lose information that could have helped explain its condition.
Evidence preservation does not mean ignoring necessary repairs or safety requirements. A vessel may need immediate action to remain afloat, protect people, prevent environmental damage, or return to a safe condition. The key is to recognize which evidence may be important and document it before its condition changes whenever circumstances permit.
Connecting Physical Evidence With Other Records
Physical evidence becomes much more useful when it can be compared with independent information.
Suppose a vessel has damage to its steering system following a collision. An investigator may examine the damaged components, then review maintenance records, engine information, navigation data, witness statements, and photographs.
Each source addresses a different part of the problem.
The physical inspection may establish the condition of the equipment. Maintenance records may provide information about its history. Navigation data may help establish vessel movement. Witness accounts may describe what operators observed. Together, these sources can help investigators determine which explanations are consistent with the available facts.
This process is especially important because no individual source is necessarily complete.
Physical Evidence in Insurance and Disputes
Marine accidents can result in significant repair costs and may lead to insurance claims or technical disputes.
In these situations, documentation of damage can become important when determining the scope of repairs and evaluating the condition of affected equipment or structures. Depending on the circumstances, insurers, adjusters, attorneys, vessel owners, or other parties may require technical information about the loss.
A damage survey and a forensic investigation are not necessarily the same thing. A survey may focus primarily on documenting condition and damage, while a forensic investigation may examine causation and the sequence of events in greater depth.
Keeping those purposes separate helps avoid drawing conclusions beyond what a particular inspection was designed to establish.
