It is designed specifically for eligible non-EEA nationals who wish to travel to the UK to join a close family member who is an EEA, Swiss, or qualifying British citizen. Crucially, the sponsor (the family member already in the UK) must have been residing in the country by the Brexit transition deadline of December 31, 2020, and must typically hold either Settled or Pre-Settled status under the EU Settlement Scheme.
Unlike standard points-based visas, this permit remains free of charge and exempts applicants from the Immigration Health Surcharge. Once granted, it provides entry clearance valid for six months, during which the holder can travel in and out of the UK, work, and study without restriction. However, it is vital to recognize that this permit is solely an entry clearance document, not a long-term residency solution.
Evaluating Qualifying Relationships and Timelines
The Home Office enforces strict definitions regarding who qualifies as an eligible family member. To successfully secure an EUSS Family Permit, you must fall into one of the recognized dependency or relationship categories, and crucially, your relationship must have existed before the December 31, 2020 deadline (with the exception of children born or adopted after this date).
Qualifying relationships include:
- Partners:Spouses, civil partners, or durable (unmarried) partners, provided the relationship was formed and subsisting before the end of 2020.
- Direct Descendants:Children, grandchildren, or great-grandchildren under the age of 21.
- Dependent Relatives:Children over 21, as well as parents, grandparents, or great-grandparents, provided they can supply robust documentary evidence proving their financial or medical dependency on the EEA sponsor.
It is important to note that certain historic routes, such as the Surinder Singh and Zambrano pathways, were formally closed to new family permit applications in August 2023, significantly narrowing the options for extended family members or returning British citizens.
